Abstract

Studies and discussions on the summa divisio (public law vs private law), as a mirror of the presence of the public and private sectors in society, span centuries and are held until today. The political and institutional history of the West registers a pendulum between the public and the private, with reflexes in the conceptions on the permanence or not of the separation between public right and private law. At the present time it is not predominating the vision of separation or counterpoint between the two branches, but a flowing exchange.
