Abstract

This article aims to analyze the possibility of applying environmental liability exemptions in Brazilian Law when polluters degrade environmental goods and services takes place. Also there is a comparison with the portuguese legal system, because this one harmonizes the environmental liability and the environmental liability exemption. So, this paper uses a descriptive-normative survey through legal literature, brazilian and portuguese laws and judgments of the Supreme Federal Court and the Superior Court, both of them of Brazil. The chapters talk about environmental liability system, ways to repare environmental damages and verify the (ir)relevance of environmental liability exemptions in Brazilian Law and Portuguese Law. Thus, this article concludes that environmental liability exemptions under created risk theory are importante and must be recognized in environmental law.
