Abstract

The author uses Niklas Luhmann's theory of social systems to carry out an analysis of the pandemic's impact on the creation and legitimation of hierarchies in the field of fundamental rights. Law can try to adapt to emergencies, but at the cost of a deep legitimacy crisis and an excess presents even more the risk of authoritarianism.
