Abstract

The present work aims to analyze the Constitution of 1824, considering the historical aspects, giving the reader an overview of the main political, legal and social events that marked the preparation of this text, reflecting on the existing dichotomies regarding constitutional values and the existence of a Moderating Power that allowed imperial despotism as well as the mismatch with regard to liberalism and the maintenance of slavery. Considering that the Constitution of 1824 was the product of a dialectical process between conservatives and liberals, the objective of this article is to understand the importance of the first constitution for the formation of the Brazilian State, to analyze its institutes, powers, structure and its role in the consolidation of national identity.
