This article moves along the line of research in Law and Literature, taking as a reference a theoretical operator under construction, Literary Law, based on the experience of searching in literature for other ways to think and (re)write the History of Law, and of rights. From a thematic point of view, we intend to address the (mis)place of motherhood in Law, thought from the writing proposed by Conceição Evaristo, in order to escre(vi)ver a fundamental right of black bodies to motherhood, considering the class and race variables that cross the approach to gender issues, based on a reading of the Evaristian short story "On the side of the body, a fallen heart”.
