In Brazil, the Federal Constitution of 1988 highlighted the importance of the environment for present and future generations and imposed on the Public Power and the community the duty to defend and preserve it for present and future generations. Faced with the need to protect nature, the following questions arise: how to guarantee the preservation of nature? Can nature be the subject of rights in legal action? This article aims to make a critical analysis about the legitimacy of nature to plead in court. To carry out the work, bibliographic and documental research was carried out, with a qualitative approach. Initially, it was approached about the evolution of the protection of the rights of nature, later about the main foundations to treat nature as a subject of law and at the end, the actions that allow, through the legitimized ones already foreseen, the possibility of the nature of seek their rights, as well as the main actions already brought on the subject are presented.
