This article aims to conduct a critical analysis of the principle of separation of powers, formulated by Charles-Louis de Secondat, Baron de Montesquieu, in The Spirit of the Laws (1748). Based on the observation of the recurrent institutional crises that affect contemporary democratic states, especially in Brazil, the article seeks to understand how the ideal of balance between powers has been strained, deconstructed or subverted in the current scenario. A qualitative approach is adopted, based on bibliographic research, using references from Political Philosophy, Political Science and Constitutional Law. The analysis covers the fundamental elements of Montesquieu's thought, articulating them with the criticisms of authors such as Bobbio, Ferrajoli and Habermas, in order to problematize the weakening of checks and balances, the hypertrophy of certain powers and the consequent threat to democratic stability. A new theory is proposed for discussion. It is concluded that the crisis of the classic model of separation of powers requires the construction of a new theory, capable of responding to contemporary challenges, incorporating normative, institutional and technological criteria that ensure the effectiveness of democratic governance in the 21st century.
