Abstract

This essay initially addresses the root causes of the worrying, increasing phenomenon of health judicialization
in Brazil, and then comments on the main controversies that characterize this type of judicial litigation, which
understandings have prevailed, and which paths are safer and more appropriate for facing the issue rationally.

Juiz federal titular da 4ª Vara da Subseção Judiciária de Uberlândia/
MG. Doutorando e mestre em direito pela UFMG. Ex-promotor de
Justiça do Ministério Público do Estado de Rondônia e ex-juiz de
direito do Tribunal de Justiça do Estado do Acre.
