VALUE OF PERSUASIVE PRECEDENTS IN BRAZIL BASED ON THE LESSON OF ALESSANDRO PIZZORUSSO

This article is based on the theoretical contributions presented by Alessandro Pizzorusso on the formation of an Italian model of persuasive precedents in a strong sense, contained mainly in his work L'ordinamento giudiziario (2019), to propose a review about the value that, in the current Brazilian context, the Superior Court of Justice (STJ) gives to persuasive precedent as a source of law. Specifically, this study analyses the way the STJ has been applying the 2015 Brazilian Code of Civil Procedure (CPC/2015) dividing precedents into two categories: binding and merely persuasive. Although not aiming at a comparison between legal systems, this research will use the comparative method to achieve a kind of export or transfer of some concepts of the doctrinal formant.
