Abstract

This essay discuss the issue of effective application of the principle of separation of Powers and questions whether it is proper to call democratic the States where it is not observed. After a theoretical grounding on the problem of power, the concept of sovereignty and limitations to state power, it advocates the thesis that there is no democracy without effective separation of Powers.
