Abstract

This paper aims to analyze the legal framework for compliance policies applicable to the Public Administration, like motivation, responsivity, risk management, besides the heap of principles and the implementation and oversight instruments defined by Decree no. 9.203/2017. The investigated problem starts out from the contextual revision of the gap so far visualized in terms governance mechanisms for performing State activities that, in the explored hypothesis, seems to have been solved by the punctuations delimitated in the theme’s new framework. The general objective of this research is to revisit the main aspects of the legal text and, in more specific objectives, the research will aim to reflect on individual innovations as to their pertinence to the main goal of the decree and also to investigate if they hold the qualities that make feasible its realization. The inductive method has been selected for this research, through a review of the highlighted topics of the norm that is being studied, with the implementation of substrates from bibliographical-doctrinaire research on the interactions between Administrative Law and governance’s policies and good practices. In the end, a conclusion will be presented, in which the paper will try to extract a more assertive comprehension in regard to the decree’s efficacy.
