Abstract

This study proposes to analyze the book “Lampião – Documentário” from the theory of criminal law of the enemy, coined by Gunther Jakobs and the approach of the theory of speeds elaborated by Jesus Maria Sanchez. Using, primarily, qualitative bibliographic research in the literature about the cangaço phenomenon and the aforementioned legal theories, this paper aims to conclude that at the time of publication of the work there were already certain inferences which are close to the theories addressed by Jakobs and Sanchez , so that cangaço was seen as a phenomenon that gave rise to the action of the enemy's criminal law. The justification for this analysis is based on the perception that groups that threaten social anomie are always seen from the perspective of the criminal law of the enemy. Therefore, it becomes evident that the phenomenon whose greatest exponent was Mr. Virgolino Ferreira da Silva, Lampião, was fought by means of the enemy's own criminal law instruments. In addition, the popular outcry guided by public opinion gave the subject contours that gave rise to swift and severe punishments for offenders.
