Abstract

The present work investigates the possibility of the Public Prosecutor or other legitimate person filing a Public Civil Action against an act of administrative misconduct, claiming for compensation of values in favour of public Treasury considering the previous conviction of the given public administrator, due to the same acts, by the Court of Auditors. The study of jurisprudence and traditional doctrine took a different view, once it is considered that this duplicity violate constitutional provisions and principles, given that despite the exoress guidance in art. 785 of the Code of Civil Procedure does not lead to the conclusion that procedural interest in a judicial conviction remains in cases where an existing extrajudicial executory instrument produced by the Court of Auditors.
