This paper shows the consecutive legislative amendments to the criminal law regarding human trafficking as well
as the influence of the Additional Protocol to the Palermo Convention, adopted by Brazil in 2004. It looks at changes
made to Act 11,344/2016 with respect to its disposition, interpretation and criminal outline of human trafficking, and
draws criticism to the legally imposed obstacles to the exercise of judicial function, given the hardship in obtaining
criminal type evidence. It addresses the issue of the victim’s consent, the protection of children, elderly and disabled,
as well as the lack of the necessary means to implement the protective measures laid down in law.
