Abstract

This study aims to investigate the system and the procedure of the Brazilian administrative misconduct law and is approximation with the fundamental rights. Initially, a brief overview of the institute of administrative misconduct law will be outlined, highlighting the seriousness of the sanctions in this context. Then, the administrative misconduct´s lawsuit will be examined within some theories debated in Brazil, in order to verify whether or not such theories apply to the object of the study. Finally, after the partial conclusions of the initial topics, the study returns to make brief notes on the fundamental rights provided for in the scope of punitive law, asking whether such fundamental rights would also be applicable in the area of ​​administrative misconduct law. At the end of the study, notes are made in order to encourage debates on the topic.

Juiz Federal Titular da 2ª Vara Federal da Seção Judiciária de Rondônia. Bacharel em Direito pela UFMG, com período sanduíche na Università degli Studi di Roma – “Tor Vergata”. Especialista em Justiça Constitucional e Tutela Jurisdicional dos Direitos na Università di Pisa – Itália. Especialista em Direito Público pela PUC/MG. Foi também Procurador Federal (AGU).
