Abstract

The paper proposes to examine the legal controversy generated by Law 10.674/2003, wich establishes the obligation on the outer packaging of the processed foods to contain the expression “contains gluten" or "does not contain gluten", as appropriate. Due to that scenario, there is one side of the tenet defending it is an inadequate term, since must be interpreted in dialogue with the Code of Consumer Protection. Based on this premise and from it on, there is the global of analyzing the function of information in the consumers' relations and the understanding given by the Superior Court of Justice (STJ) about the theme. It concluded that the mere mention "contains gluten", is not considered as satisfactory, since it does not fulfill one of the functions of the right to information, that is, to warn about the risks that the product offers the consumer.
