Abstract

The text discusses the introduction of the rules related to the jurisdiction of international criminal courts in the Brazilian Federal Constitution, with the inclusion of art. 5th, par. 4th, under the terms of Constitutional 45/2004. It addresses the genesis of the final text of PEC 29/2000, transformed into Constitutional Amendment 45/2004. It reflects on constitutional topographical inadequacy, terminological inaccuracies, and the purpose of “constitutionalizing” the Rome Statute with the insertion of par. 4 in the art. 5th of the Brazilian Constitution. Eventually, it considers that the principle of complementarity, which motivates the jurisdiction of the International Criminal Court, preserves the primacy of the analysis of cases by Brazilian courts. It concludes that the rules provided within the Rome Statute are compatible with the Brazilian Constitution.
