The applicability of procedural legal transactions to the disciplinary administrative conduct of the armed forces

Abstract

The study aims to analyze the application by analogy of the “procedural legal transaction”, institute of the Brazilian Code of Civil Procedure, in disciplinary lawsuits by Brazilian Armed Forces. For that, the suitability hypotheses were applied in Brazilian Air Force Code of Discipline and in the possibility contemporary trends in activity of the Armed Forces and pillars of hierarchy and discipline coexistence with the “procedural transaction”. As an argumentative reinforcement, some provisions were identified in foreign codes of discipline and domestic doctrinal understanding regarding the use of the institute to the field criminal and administrative law. The bibliographic referential methodology was adopted in the research, using books, articles, Brazilian legislation and foreign legislation, with the subject studied here.
