Old criminal record: dosimetry criminal and right to be forgotten

The article deals with the impact of unappealable convictions for a long time in the valuation of the criminal record of the defendant. It analyzes the evolution of the jurisprudence of the Federal Supreme Court and the Superior Court of Justice, based on the understanding that convictions extinct for more than 05 (five) years can be negatively valued as bad precedents, but advancing towards applying the theory of law to oblivion in the event that the antecedents are very old. Then, considerations are made about the perpetual nature of penalties and the principles of isonomy and individualization of the penalty, in addition to the discretionary judgment of the judge.
