The present academic work aims to develop a comparative approach concerning to the disregard of the legal personality between the previous text of article 50 of the Brazilian Civil Code, the doctrine and jurisprudence on the matter and the new wording of the legal provision brought by Law no. 13.874 / 2019, generated through the approval of Provisional Measure No. 881/2019, popularly known as "Provisional Measure of Economic Freedom", highlighting the points in which the legislator innovated or simply received the consolidated understandings of scholars and jurisprudence produced by Courts, in a manner to curb the abuse of the legal personality, whether by confusion of assets or by deviation of purpose.
