The objective limits of res iudicata: an analysis about its potential expansion

Abstract

The approach between the authority of res judicata and the institute of issue preclusion of North-American law was extremely important for the amplification of the objective limits of res judicata in Brazilian procedural law, provided for in art. 503, §§ 1º and 2º of Brazilian Civil Procedure Code/2015. Owing to the legal security and the logic of the system, this article seeks, through the bibliographic study of legal doctrine, to argue that the legislator could have developed his perception a little more, extending the objective limits of the res judicata to the fundamental issues for the judgment of the request, even though it is not precisely about prejudicial questions.
