Access to Justice for refugees in Amazonas: the haitian and venezuelan experience
Keywords:
access to justice, refugee, Republic of Haiti, Republic of Venezuela, AmazonasAbstract
Since 2010, the state of Amazonas has seen an intensification of migration from neighboring countries, a phenomenon caused by economic, political and environmental factors. In a deeper analysis, it is denoted that much of this migration is formed by the humanitarian crises in Haiti and Venezuela that still persist. In view of this reality, it was necessary to consider the vulnerability of refugees. In this sense, we seek to evaluate the demand of these individuals in the Amazonas geographic space, the existence of legal institutes capable of providing due protection to the immigrant individual, especially with regard to its characterization as a refugee and the measures of State action to ensure their fundamental rights, in this case, the access to justice. That said, this article aims to analyze the experience of Venezuelans and Haitians in the state, as well as the social paradigm faced by these individuals, from the legal-sociological methodological perspective based on a doctrinal bibliographic survey.
