Abstract

The Political Letters of the States in the post-war period surprised us that the modern State of Law does not solve, and can even deepen, the great problems of humanity. The Democratic Rule of Law imposes itself in most western countries as a new look of the State on the human being, no longer admitting that the State is sufficient in itself, but that human dignity is its foundation. The realization of fundamental rights and the deepening of participatory democracy are the basis of this contemporary State. To this end, especially after the global economic and financial crisis of this millennium, the Administration is now guided by a new model of action. Democratic public governance imposes itself as the best way for the contemporary State to fulfill its constitutional role of realizing fundamental rights. Decentrality in political decision-making, with the participation of all non-governmental social actors, with a government open to civil society, is a form of constitutional manifestation of the role of the contemporary Democratic Rule of Law. To do this, develop a number of controls that must be implemented and improved by management. Participation and in-depth social control use tools that prove to be efficient for the development of democratic public governance by the Public Administration.
