Abstract

This article presents the results of a bibliographic review research whose objective was to map the place of art, and especially of literature, in the social theory of Jürgen Habermas, with the objective of contributing to the elaboration of theoretical-methodological contributions to the studies and research in Law & Literature. The main conclusion concerns the need to rethink the surrealist paradigm of these researches, which approach what Habermas called the hibernation strategy typical of the first generation of the Frankfurt School, as well as shift the focus of such studies to the mode of reception of literary works, rather than in their authorship or in the work itself.
