Abstract

The present study aims to analyze the constitutional rule regarding the Executive Power, with regard to the investiture, the hypotheses of impediment or vacancy and the attributions of the President of the Republic, the Vice-President of the Republic and the Ministers of State. It can be seen that, today, the Executive Branch assumes varied meanings, in which the State Power and the functions of government are confused in the same person. This personalization of the executive branch stems from the evolution of the monocratic or unipersonal presidential system, which centralizes the Executive Power in the figure of the President of the Republic. This work aims to deal with the presidential system of government according to the Federal Constitution of 1988, as well as to deal with the main judicial decisions regarding the exercise of the Presidency of the Republic.
