Abstract

This article has the objective to analyze literature as a legal-political institution where everything can be said, and the problems that arise from this conception in the current social context, mainly when put alongside other modern institutions of power, such as the State and capital. The methodology used will be the survey and analysis of the bibliography, mainly based on the reading of That strange institution called literature (2014) written by Jacques Derrida, proposing a complementary critique of what is theorized using the notions of an-anarchy developed by Andityas Matos (2022). The text concludes that, for literature as an institution to keep itself in its possibility to say everything inside a society controlled by the State and capital, it should assume an an-archic position. The originality of the approach lies in the deviation of the canon that approaches the relationship between Law and Literature, presenting such relation not only from a possibility of the literature deconstruct and dismantle the structures of the Law, but also concerning the deactivation that the literature can provoke in the legal structures by assuming an an-archic posture.
