Abstract

Not all conduct that is dangerous to the legal good is prohibited by the legal system, and this is the ratio of the so-called allowed risk. This paper deals with the categories of this institute, having, in general, three moments: analyze whether the term allowed risk is the most accurate; verify how the criteria for the legal valuation of the risk created appear to have certain patterns of relation and the possible reasons why this occurs; reflect on the foundation of the idea and the insufficiency of the dominant opinion – consisting in the weighing of interests – on the subject.
