Abstract

This article aims to analyze the hypotheses of applicability and the role of constitucional complaint in controlling
application of binding decisions, in light of the normative conformation contained in the Code of Civil Procedure of 2015.
It seeks to undertake critical reflection regarding the judgement of Rcl nº 36.476 by the Superior Court of Justice, which
understood that constitutional complaint was not appropriate for the purpose of guaranteeing compliance with the
decision rendered in judgement of repetitive special appeals (art. 988, § 5, II, of CPC). In this way, the text investigates the
accuracy of the grounds adopted by the STJ, the impacts of this decision on Brazilian system of precedents and resulting
dysfunctions, especially in view of the current jurisprudence of the Federal Supreme Court, whose understanding of this
subject is divergent.
