Abstract

This study explores the deliberation in the jury as well as decision rules for a veredicto. At first, an annalyse is done
about some of the principles that guide the jury in Brazil: the presumption of innocence, the incommunicability
of jurors and the secrecy of veredicts. Following, it is supported a view of the jury as a deliberative democratic
institution that has the function of discovering and deciding about facts and point positive aspects that deliberation
brings to the quality of the juror’s decision. In the end, it is brought a debate about advantages and disadvantages
of decision rules such as majority, unanimity, supermajority and assimetry, concluding with a suggestion of a model
to be adopted.
