Abstract

This text focuses on a delicate and relevant issue, which currently faces the Corregedorias de Justiça and the National Council of Justice itself: is there specific conditions on the designation of interim agents for notary and registry services? Or yet: the Provision 77/2018, of the CNJ, suffers from a legal defect? The following article, starting from the thematic of the constitutional principles and the legal nature of the notary and registries services, proclaims the full validity of said Provision 77 and the fullfilment of the principles of morality and the prohibition of nepotism in the interim designations presently in question. It also betake the jurisprudence of the Federal Supreme Court to support this thesis.
