Abstract

Based on the conception that Criminal Law has as goal the subsidiary protection of the legal assets, guiding itself by
the constitutional principle of human dignity and based on the Roxin’s criminal liability, it follows that (a) the criminal
dogmatic must maintain a constant dialogue with the criminal policy and (b) the concept of culpability must be associated
with the preventive nature of the penalty, maintaining culpability as a limiting principle of the criminal sanction.
